Terms and Conditions

MillionAire Heating, Air & Plumbing Last updated: October 1, 2026

Please read these Terms and Conditions ("Terms") carefully. They govern your use of millionairecooling.com (the "Site") and the heating, air conditioning, and plumbing services we provide ("Services"). By using the Site, requesting an estimate, scheduling service, purchasing products, or allowing us to perform work at your property, you agree to these Terms. If you do not agree, please do not use the Site or request Services.

1. Who We Are

MillionAire Heating, Air & Plumbing ("MillionAire," "we," "us," or "our") is a family-owned heating, air conditioning, and plumbing contractor serving the Dallas–Fort Worth metroplex.

MillionAire Heating, Air and Plumbing, LLC 206 W Bedford Euless Rd. Hurst, TX 76053 Phone: (817) 952-5340 Email: info@millionairecooling.com

Plumbing services are regulated by the Texas State Board of Plumbing Examiners, 7915 Cameron Road, Austin, TX 78754, (512) 936-5200, tsbpe.texas.gov.

2. Service Area

We provide Services within our published service area in the Dallas–Fort Worth metroplex. Appearance of a city or neighborhood on our Site does not guarantee availability on a given day. We may decline or discontinue service to any location at our discretion, including for safety reasons, access problems, or distance.

3. Scheduling, Dispatch, and Diagnostic Fees

Requesting an appointment through the Site, by phone, or by text is a request only. An appointment is confirmed when we confirm it to you directly.

Appointment windows are estimates, not guarantees. Emergencies, weather, traffic, parts availability, and jobs that run long can move a window. We will make reasonable efforts to notify you of delays.

A diagnostic or dispatch fee may apply to service visits and is disclosed before we are dispatched. This fee covers travel and the time required to diagnose the problem. It is separate from the cost of any repair, and it is earned whether or not you proceed with the repair, unless we tell you otherwise in writing.

After-hours, weekend, and holiday service may be billed at premium rates, disclosed before dispatch.

4. Cancellations and Missed Appointments

Please give us as much notice as possible if you need to cancel or reschedule. If no one at least 18 years of age is present to provide access at the scheduled time, or if the equipment or work area cannot be reached, we may treat the visit as a missed appointment and charge the applicable dispatch or trip fee.

5. Estimates, Quotes, and Pricing

Estimates are based on the conditions visible and the information available at the time they are prepared. Unless stated otherwise, an estimate is valid for 30 days and may be revised if conditions change, if concealed problems are discovered, or if supplier pricing changes.

Prices shown on the Site are subject to change and may contain errors. We reserve the right to correct pricing errors and to decline or cancel any order or job arising from an error, including after an order is placed.

Additional work beyond the scope of an approved estimate requires your approval before we proceed, except where immediate action is required to prevent injury or further property damage.

6. Your Right to Cancel Certain In-Home Sales

Under federal and Texas law, if you purchase goods or services valued at $25 or more as a result of a sale made at your home, you generally have the right to cancel the transaction within three business days. Where this right applies, we will provide you with written notice of your right to cancel and a cancellation form at the time of sale. If you ask us in writing to begin emergency work before that period ends, you may waive the right to cancel to the extent permitted by law.

7. Access to Your Property and Customer Responsibilities

To perform Services, you agree to:

  • Provide safe, lawful, and unobstructed access to the equipment and work areas, including attics, crawl spaces, mechanical rooms, water heaters, and shut-offs.
  • Secure pets away from work areas.
  • Disclose known hazards, prior repairs, unpermitted work, and the location of utilities, septic systems, irrigation lines, and underground or in-slab lines where known.
  • Confirm you own the property or are authorized to approve the work.
  • Move or protect valuables, vehicles, and personal items near the work area.

If you authorize work on a property you do not own, you represent that you have the owner's permission and you remain responsible for payment.

8. Concealed Conditions and Hazardous Materials

Heating, cooling, and plumbing systems are frequently installed behind walls, under slabs, above ceilings, and in attics. We cannot see or test what is concealed. We are not responsible for pre-existing conditions, prior substandard or unpermitted work, code deficiencies that existed before we arrived, deteriorated or corroded materials, or damage that occurs as the unavoidable result of accessing a concealed component using accepted trade practices — including cutting access openings in drywall, ceilings, or landscaping.

Unless specifically included in a written scope of work, we do not provide drywall finishing, texture, paint, tile, flooring, or landscape restoration.

If we encounter asbestos, mold, lead, sewage, vermin, structural damage, or other hazardous or unsafe conditions, we may stop work and will not resume until the condition is remediated by a qualified party at your expense.

9. Permits, Codes, and Inspections

Where required, we obtain permits for the work we perform and arrange inspections with the authority having jurisdiction. Permit and inspection fees may be charged separately. You are responsible for any homeowners association approvals, deed restrictions, or landlord consents.

We are not responsible for bringing unrelated portions of an existing system up to current code unless that work is included in your written scope.

10. Payment

Unless we have agreed otherwise in writing, payment is due upon completion of the work. Installations and large repairs may require a deposit and progress payments.

We reserve all lien rights available under Texas law, including statutory mechanic's and materialman's liens.

Returned payments may be subject to a fee. Chargebacks initiated without first contacting us do not relieve you of the obligation to pay for work performed.

11. Financing

Financing offers shown on the Site are provided by independent third-party lenders. We do not make credit decisions, set rates, or control approval. All financing is subject to the lender's terms, credit approval, and separate agreement between you and the lender. Advertised rates and promotional terms are subject to change and may not be available to all applicants.

12. Workmanship Warranty

If covered work fails within that period, we will repair or re-perform it at no labor charge to you.

This workmanship warranty does not cover:

  • Equipment and parts, which carry only the manufacturer's warranty (see Section 13)
  • Problems caused by lack of routine maintenance, including failure to change filters
  • Damage from misuse, abuse, accident, vandalism, pests, power surges, flooding, freezing, storms, or other events outside our control
  • Work, repairs, or modifications performed by anyone other than MillionAire
  • Pre-existing conditions, unrelated components, or conditions described in Section 8
  • Systems or components we recommended replacing where you elected to repair instead
  • Clogs, stoppages, or drain issues caused by items that should not be introduced into the system

Warranty service is available during normal business hours. After-hours warranty calls may incur a trip charge. Warranty coverage is void on accounts with an unpaid balance, and is extended to the original customer at the original service address only. It does not transfer unless we agree in writing.

13. Equipment and Manufacturer Warranties

Equipment, parts, and materials carry only the warranty provided by their manufacturer. We pass those warranties through to you and will help you file a claim, but we do not provide, extend, or guarantee them. Manufacturer warranties commonly require product registration within a set period after installation and proof of annual maintenance; failure to meet those conditions can reduce or void coverage, and that is outside our control.

Manufacturer warranties typically cover parts only. Labor, refrigerant, diagnostic time, and shipping associated with a manufacturer warranty claim are generally not covered and may be billed to you.

14. Maintenance Membership Plans

Membership plans are agreements for scheduled maintenance and member benefits as described at the time of enrollment.

  • Membership benefits apply only while the membership is active and paid current.
  • Plans billed on a recurring basis renew automatically until cancelled. You authorize us to charge your payment method on file at the then-current rate each billing period.
  • You may cancel at any time by contacting us at (817) 952-5340 or the email above. Cancellation takes effect at the end of the current billing period.
  • Unless stated otherwise, membership fees are non-refundable, and unused visits do not carry over or convert to cash.
  • Memberships cover the enrolled property and equipment only, and do not transfer without our written consent.
  • We may change plan pricing or benefits with notice before your next renewal.

15. Product Purchases (Filters and Other Items)

Products purchased through the Site are subject to availability. Filter sizes, model compatibility, and fitment are your responsibility to confirm before ordering. Images are representative and actual products may vary.

16. Coupons, Promotions, and Discounts

Unless stated otherwise on the offer:

  • Coupons and promotions must be presented or mentioned at the time of scheduling, before work begins.
  • One offer per customer, per visit. Offers cannot be combined with other discounts, membership pricing, or promotions.
  • Offers apply to new work only and cannot be applied retroactively to completed jobs or outstanding invoices.
  • Offers have no cash value, are non-transferable, and may be modified or discontinued at any time.
  • Offers are subject to the expiration date, minimum purchase, equipment, or qualifying-service conditions printed on them.
  • Price-match and guarantee offers are subject to their own published terms, including proof requirements and comparable scope, equipment, and warranty.

17. SMS / Text Messaging Terms

MillionAire Heating, Air & Plumbing offers text messaging to customers who opt in on our website to receive messages about their service request, appointment reminders and service notifications. By providing your phone number, you agree to receive recurring automated marketing messages. Message and data rates may apply. Reply STOP to opt-out. Message frequency varies. Reply HELP for help, or contact us at (817) 952-5340. Consent to receive text messages is not a condition of purchase. Carriers are not liable for delayed or undelivered messages. For details on how we handle your information, see our Privacy Policy.

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Information may be shared with subcontractors or service providers that support our messaging and customer service operations, and those parties may not use it for their own marketing.

18. Phone Calls, Recording, and Email

Calls to and from our office may be monitored or recorded for quality assurance, training, and dispatch accuracy. By calling us, or by requesting that we call you, you consent to that monitoring and recording.

We may use automated or prerecorded calls and text messages to reach you about scheduled service, technician arrival, and account matters. Providing your phone number on our Site or to our staff constitutes consent to be contacted at that number regarding your request, including by automated means. You may withdraw consent for marketing contact at any time; we may still contact you about active jobs, warranty matters, and billing.

If you provide an email address, you may receive service-related email. Marketing email includes an unsubscribe link.

19. Reviews, Photos, and Customer Content

We may photograph completed work for quality control, warranty documentation, training, and marketing. Photographs of equipment and work areas generally do not identify you. We will not publish images that identify you, your family, or your street address without your permission.

If you submit a review, testimonial, photo, or other content to us or about us, you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, and display it in our marketing, with attribution limited to first name and city unless you agree otherwise. You are responsible for the content you submit and represent that it is truthful and that you have the right to submit it.

20. Use of the Site

The Site and its content — text, graphics, logos, photographs, and layout — are owned by MillionAire or our licensors and are protected by copyright and trademark law. You may view and print pages for your personal, non-commercial use. You may not copy, scrape, republish, or use our content for a competing business.

You agree not to interfere with the Site, attempt unauthorized access, submit false information, or use the Site for any unlawful purpose.

Content on the Site is provided for general informational purposes. It is not professional, technical, safety, or code advice for your specific situation, and should not be relied on as a substitute for an on-site evaluation. If you smell gas, suspect a gas leak, or suspect carbon monoxide, leave the building immediately and call 911 and your gas utility — do not wait for us and do not rely on information on this Site.

The Site may link to third-party websites and services, including financing partners, manufacturers, coupon platforms, and review sites. We do not control them and are not responsible for their content, products, or practices.

21. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

22. Disclaimers and Limitation of Liability

Except for the express workmanship warranty in Section 12, Services and products are provided "as is," and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose, to the fullest extent permitted by law.

To the maximum extent permitted by Texas law, our total liability arising out of or relating to the Services, the Site, or these Terms will not exceed the amount you paid us for the specific job giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost income, spoiled food or product, hotel or relocation costs, mold growth, or loss of use, even if we were advised of the possibility.

Nothing in these Terms limits liability that cannot be limited under Texas law, including liability for gross negligence, fraud, or personal injury caused by our negligence.

You agree to indemnify and hold MillionAire and its employees harmless from claims arising out of your breach of these Terms, your misrepresentation of property ownership or property conditions, or your instruction to proceed against our written recommendation.

23. Events Outside Our Control

We are not responsible for delays or failures caused by events beyond our reasonable control, including severe weather, grid failures, supplier and manufacturer shortages, shipping delays, labor disruptions, permitting backlogs, acts of government, fire, flood, or public emergencies.

24. Dispute Resolution and Governing Law

If a problem arises, please contact us first at (817) 952-5340 so we can try to resolve it directly. Most issues are resolved quickly this way.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Tarrant County, Texas, and you consent to the jurisdiction of those courts.

Any claim must be brought within the time allowed by Texas law.

25. General

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these Terms without our consent; we may assign ours in connection with a sale or reorganization of the business.

These Terms, together with any written estimate, work authorization, invoice, or membership agreement you sign, constitute the entire agreement between us. Where a signed written agreement conflicts with these Terms, the signed agreement controls for that job.

We may update these Terms at any time by posting a revised version with a new "Last updated" date. Continued use of the Site or Services after changes are posted constitutes acceptance.
